That cop was trying really hard to get the guy to bump into him so he could charge him with assault on an officer.

I'm amazed.... Of course, I'll be even more amazed if he's not promptly hired the next town over

“Five days after the incident, Chief Mondary confirmed the officer is no longer with the department.” Then he immediately got hired as an ICE agent (probably) 😂

The other cops should have been held accountable too. They should have stepped in and stopped the aggessure. I believe if you hold all the accountable you might see good cops (if there are any) start to step in. It shouldn't be after the person's life has been turned upside down.

We give too much benefit of doubt to all cops.

9

u/Unusual-Thing-7149 2d ago

But they must be good cops right? Bad cops are a tiny minority apparently but the good cops couldn't tell the bad one to back off. So are they good, just as ignorant of the law or actually bad cops or frightened of the blue brotherhood?

12

u/mmorales2270 2d ago

A so called “good cop” that doesn’t at least attempt to stop a colleague from harassing a citizen is just a bad cop in my eyes.

u/NeatNefariousness1 2d ago

The good cops would get more of the support they’re due if there weren’t so many instances like this where the “good guys” stand back silently watching as a colleague escalates situations in the field. We KNOW that there are more good cops than bad ones but seeing the number of cops silently watching as a rogue cop goes off the rails instead of helping him and the victim by restoring order, is a bad look.

Standing by, doing nothing when a cop is becoming unglued, gives the appearance that ALL of the cops witnessing what is happening approve of the bad acts and escalation being driven by a single cop whose adrenaline and emotions have gotten the best of them. Not only does allowing this to happen put everyone in danger, it gives the appearance that there is tacit agreement with the lead cop’s bad acts.

My faith in cops is dramatically increased when I see instances where one of them (a peer or a supervisor) steps in to de-escalate tense situations that are aggravated by ego, testosterone and a misunderstanding of the law. What cops do in these tense moments is what helps change the fear that there are more bad cops than there actually are.

Authority figures who do nothing when something bad is happening in front of them is a bad reflection on them whether or not they were the protagonist.

No, he's "no longer with the department," and they won't comment further. That means allowed to resign and go be a cop elsewhere. When they actually fire a cop, they don't get the special protection.

That policy is specifically in place to obfuscate in these situations

It is the Peace Officers' Bill of Rights, often also called the Law Enforcement Officers' Bill of rights in places, and yes, they generally codifiy into law the idea that police officers have different, extra, special rights than you or I from the sole fact that they are a police officer. It's truly digusting, it was just used in my state to reinstate an officer who beat a handcuffed suspect

Edit: just reveiwing the details, the cop in my state plead guilty to assault (kicking and punching a hand-cuffed man) and was still reinstated after a suspension of 45 days. Check this shit out:

Hanley’s saga is one of the cases that prompted Rhode Island legislators to overhaul the state Law Enforcement Officers’ Bill of Rights last year. The new measure increases the size of panels that will review LEOBOR cases, and changes the way the panels are chosen — previously, the accused could pick one of the panelists.

Imagine being able to choose your god damn judges, absolutely wild, if the whole concept of POBAR/LEOBAR isn't a miscarriage of justice I don't know what the fuck is

There though. People win constitutional cases against police everyday.

40

u/Dirtymikeshalfcousin 2d ago

Cops also get away with this shit every day

7

u/Dedpoolpicachew 2d ago

Which is why cops should have to have malpractice insurance, like lawyers and doctors. So the tax payers aren’t the ones on the hook for their shitty behavior. This would also tend to weed out the bad cops because their rates would skyrocket after they fuck up, and they wouldn’t be able to get or afford the next rates. There also needs to be more intensive training and screening of these cops. Far too many are roid ragers, and have been abusers of their own families. If they’ll beat their wives, why not an innocent “mad dogging” him??

3

u/Dirtymikeshalfcousin 2d ago

I agree. Unfortunately, I have no hope of any of this happening.

31

u/MuffleeOfficial 2d ago

Then we pay for it and not the officers who lost the suit. Isn’t that awesome?

19

u/KillionMatriarch 2d ago

If settlements were paid out of the police pension funds, there would be an immediate change in behavior.

14

u/KoolWitaK 2d ago

Individual insurance like doctors have. The rate increases after the thousands of payouts would actually change things real quick.

7

u/NorthNorthAmerican 2d ago

This is starting to happen, although not in the direct way you mentioned:

Reinsurance co's are refusing to back some municipalities because their police departments are costing so much in payouts. The insurance co's are demanding changes in policies and procedures to reduce exposure.

those are civil and the public is footing the bill for those pay outs. at most they go through internal review, which is their own guys who may or may not give a shit. and if they do it results in minimal penalties or lowered chances at promotions, at most.

Winning happens but qualified immunity is a real hurdle and some judges will use it in just about any cop case. All the city's lawyer needs to do to get the case thrown out on QI grounds is find some reason that this is different from a previous published court case where similar conduct was found to be unconstitutional. "Oh, well this was a Terry stop because the plaintiff was sitting suspiciously on the hood of his car. He sprayed some saliva while he talked to the officer that was 2 inches from his face and the officer felt in fear for his own safety."

“Contrary to what’s being said online, the officer did not commit a crime,” Chief Mondary said

Bullshit. Arbitrary detention is absolutely against the law

3

u/9outof10timesWrong 2d ago

You expect the police to know the law? Isn't that asking a bit much?

3

u/ZennTheFur 2d ago

If literally anybody else did what this cop did, they'd have like half a dozen charges. But because he's a cop, he's above the law.

→ More replies (1)

8

u/hashtag-adulting 2d ago

"Amid social media speculation, Mondary also addressed claims of racial bias: “This incident had nothing to do with race. While the officer may appear to be white, he is Hispanic and has never shown any form of racial prejudice while serving in our department.”"

It couldn't possibly be race-driven because the officer in question is a white-presenting Hispanic?!

6

u/Lucky-Acanthisitta86 2d ago

Terrible response. He should no longer be able to be a cop anywhere ever again. If cops went into the job knowing they would get rightfully fired for ridiculous behavior that would get anyone fired at any other job, they would act a lot differently

Chief Mondary confirmed the officer is no longer with the department.

That doesn't mean he got fired. If they were that concerned that they fired him they'd want the public to know just how serious they took it and they'd just say so.

It literally just means he's been moved to another department.

3

u/Redit2158 2d ago

Thanks for the update. He's not with the department anymore, but he will get another job somewhere else and do the same thing to someone else. He's a bully. He will always be a bully. Lately, because of so many situations like this, I think of Motorheads song "Just ' cos you got the power doesn't give you the right"

3

u/Semperty 2d ago

he’s no longer with the department, but you can rest assured knowing he’s harassing people under a different department’s jurisdiction.

3

u/EverythingBOffensive 2d ago

so he transferred

3

u/WOLF-123_ALPHA 2d ago

This is a great example of how cameras and public scrutiny are needed. If this hadn't been on camera and discussed on social media, that dirty cop wouldn't have been held accountable. This could have escalated and eventually lead to a subsequent assault or fatality down the line.

u/Adventurous_War_3312 2d ago

Unfortunately, this guy has no business being a police officer. He has zero deescalation skills.

62

u/koushakandystore 2d ago

It’s actually way worse than that. He is actively trying to escalate the situation into violence. I know this department well, I grew up there. The cops in that town are well known for being hot heads, corrupt, with itchy trigger fingers. They have an inferiority complex for being rejected by the much classier department on the other side of the valley. Pretty typical police behavior in a low income city. Police love to pick on people in low income communities.

15

u/I-Love-Tatertots 2d ago

When my younger brother and I were still in school, he had a school resource officer get in his face in the dean’s office and repeatedly tell him stuff like “go ahead, take a swing” “hit me” and just taunting him trying to provoke a response.

My brother and I are not violent people.  We only ever get physical out of self defense and will never hit first.

But that cop really fucking tried, just so he could arrest my brother.

Fuck you Officer Wiggins.

3

u/ImNotCleaningThatUp 2d ago

Yeah! Fuck you Officer Wiggins! I’m glad your brother kept his cool. I don’t know why some police officers and such just want to push people to fuck up their own lives. Nothing would have happened to that asshole, but your poor brother would have been immediately labeled as violent and no one in the future would bother to take the time to find out the circumstances of the situation.

Crazy how the cop is literally straddling the guy and all up in his personal space but he’s entitled to arrest the guy if he’s slightly bumped. And then he ends up arresting the guy because being called “retarded” hurt his feelings lol.

3

u/skoooop 2d ago

It's wrong on so many levels. If you stand like that he can't leave.

“Contrary to what’s being said online, the officer did not commit a crime,” Chief Mondary said.

Here's the Prima Facie case for false imprisonment according to the Cornell Legal Encyclopedia:

  1. The defendant willfully acts . . .

  2. . . . intending to confine the plaintiff without the plaintiff's consent and without the authority of law

  3. the defendant's act causes the plaintiff's confinement

  4. the plaintiff is aware of the confinement

I ain't no big city lawyuh (IANAL) or nothin, but that sounds a lot like what happened in this video. Since they're allegedly investigating a crime, there could be a case for "authority of law" in point 2, but the video sure makes it seem like the investigation was over since the only thing discussed is the straddling before the officers start walking away.

That’s just such a stupid thing to say. I am sure there assholes like him with big dicks. Just saying!

3

u/TimAllen_in_WildHogs 2d ago

I'd say from experience, people with big dicks tend to be more of an asshole to others because they've been able to go through life cocky and egotistical since they know they can never be shamed about their penis size (obviously not representative of everyone with big dicks). They've grown up in a world where they are constantly told the ideal penis is the one they have. They get hookups easily and can never be the punchline, so they often are the first one to throw jabs.

Like, who is most likely going to be an asshole?

  • the hung jock who has never been told no and does whatever he wants?

  • the quiet jock who doesn't like attention on himself because he's been bullied his life in the lockerroom?

I've played hockey my whole life, and I still play weekly in my 30s, and I can confidently say its the hung dudes who love showing off doing helicopters in the locker room that tend to be the first to body shame and make fun of anyone who is not hung.

I almost guarantee he’s working as a cop like one county over

u/Anjunabeast 2d ago

Name kept private. Investigated internally. Definitely working another department.

This guy has ICE all over him. I'm sure this video made him an easy hire over there

4

u/KnowMatter 2d ago

At this point when a video like this comes out I assume Pam Bondi shows up at their house afterwards like Sam Jackson to recruit them into ICE.

i googled around looks like this officer got fired, this video is from july 9 2018. i couldn’t find their name but i did see this department (desert hot springs) fired ANOTHER officer later that year for sleeping with informants lmfao

6

u/LocalInactivist 2d ago

The PD won’t release the cop’s name. That might affect his ability to get another job.

4

u/CrescentSmile 2d ago edited 2d ago

The officer in the 2018 video has been publicly identified as Paul Huerta (has been going by Jay Huerta for reasons). Further PD work experience for another year after the incident.

Wrangell, Alaska PD (June 2019–mid‑2020)

“He then moved to Desert Hot Springs, also east of Los Angeles, where he worked for over a year. It was not exactly what he was hoping for, however. He said that he wanted to be in a place where he could talk to people and get to know their names while on the job. In California, the pace of work just did not allow for that.”

lol so fucked up… the video certainly shows he get nose to nose with someone and got his name by arresting him with no cause...

We all know. He was moved to a different precinct & continues to be a menace.

Aside from ending Qualified Immunity, we must start a National LEO Licensing Registry just like they have for RN's & make them carry liable insurance too!

We need them to fear for their jobs if they get out of pocket. Make it follow thm like student loans!

Five days after the incident, DHS Police Chief Dale Mondary says the officer is no longer employed with the department.

Every cop there is just as responsible for this as the ass hole that put on the cuffs. They should all lose their jobs.

When this sort of abuse and unlawful orders start resulting in a few of them being shot point blank maybe the dregs will recall that they signed up for a tax funded public servant job not public abuse free pass.

I watch things like this, and wonder, why isn't this entrapment? The cop is purposefully antagonizing someont to try and get them to commit a crime, but the impetus for entrapment is getting someone to do something they wouldn't do otherwise through excessive means.

No cop should ever be antagonizing a "suspect". If you have reason to arrest them, then do that. There is no reason to stand over them and demand answers, or treat them like shit before hand.

5

u/lilithbepraised 2d ago

I got arrested for calling a cop a pig. When I asked why I was being arrested he said "bc I'm a fucking pig". They don't need an excuse to arrest you

This is why I will always say that civilians should be able to defend themselves against police officers..this is bs and if this were another civilian he would've defended himself im sure but these cops are bs💯

4

u/ApolloScud 2d ago

You raise a question here that should be getting way more attention than it does because what is the point of having any kind of so-called rights if we as citizens are forced to comply with a bad cops demands for fear of life, safety or economic vulnerability (meaning, I don’t have the cash to fight this bullshit in court)? The system is backwards The cop is deciding whether or not you have rights - aka “being on a power trip’

Citizens should not have to worry about ending up a paraplegic just because they stand straight in the face of a crooked cop And a dirty cop should know that she or he is likely to get back just as good if not worse than what they’re giving if they decide to go rogue.

It should be that if you are caught breaking the law as an active police officer you should face not only an automatic prison sentence but double that of a civilian for the same crime for dishonoring the badge and breaking the public trust.

No wonder no one likes cops and never will cause of this.. EVER...

6

u/falcrist2 2d ago

There are 3 cops in this video.

One of them is being evil.

The other two are standing there watching it happen.

So... all three of them are being bastards.

Hence the slogans people often use to refer to the police.

Imagine what the cop would have done had there been no camera recording him.

4

u/GuruTheMadMonk 2d ago

Fucking stupid, idiot, power-mad cop escalating the situation and physically menacing this guy. Thoroughly unqualified. Calling a cop a name isn’t against the law and meriting arrest.

Think of how poorly he must treat his family!

u/AlternativeMode1328 2d ago

The only crimes I see are the cop’s bruised ego and his dangerously low emotional intelligence.

Abuse of power, another reason the population doesn’t trust or like cops…

3

u/Preciousopoly 2d ago

Cop broke no laws... And that's the fucking problem...

3

u/somanysheep 2d ago

We MUST end Qualified Immunity, FOR CITIZENS SAFETY! Because at the end of 5G day, our lives are more important than anyone who, not only, signs up for the paycheck but takes an oath to serve & uphold the Constitution.

They also need a law stating anyone who breaks the law while bound by an oath to uphold the Constitution is an automatic 3rd strike.

We have to hold those responsible for so much power over us to a much higher standard, not the free reign they have now. If they can't "do the job" without breaking the law, then they should find a different career path.
